Gym Jones Membership Terms and Conditions (Membership Buyers)

By clicking "Accept" you represent and warrant that you are at least eighteen years of age and agree to be bound by these membership terms and conditions, (“Membership Terms”) which shall govern the use of the Company’s subscription-based content as set forth on GymJones.com,. If you are not at least eighteen years of age and/or do not accept the Terms and Conditions and/or the Membership Terms governing the use of the Company’s subscription-based content as set forth on GymJones.com, do not click "Accept" at the bottom of this page and your transaction will be cancelled.

The different categories of current memberships, subscription plans, and corresponding pricing are set forth on the Company’s subscription based website, GymJones.com. The Company reserves the right to change or alter these memberships and pricing structures in whole or in part at anytime in its sole discretion.

The Zealot membership is a month-to-month membership that can be cancelled at anytime subject to certain restrictions as set forth below.

The Zealot Premium membership is designed to be an annual membership that is billed monthly at a reduced rate to the standard Zealot membership. Accordingly, the Zealot Premium membership has a three (3) month guaranteed commitment and minimum payment requirement. After three (3) monthly payments have been received, the Zealot Premium membership may be cancelled at anytime subject to certain restrictions as set forth below.

The Salvation membership is an annual membership that is billed once per year. The total amount is due upon registration, and annually thereafter The Salvation membership may be cancelled at anytime, but no refunds will be given, prorated or otherwise.

Upon choosing your subscription plan, you will be billed the amount due at the time of checkout. In the event you choose a subscription plan using the per month billing option, www.stripe.com will automatically bill the credit card account you provide upon registration with the GymJones.com subscription site each month for the term of your subscription.

The Company uses a third party payment processor, www.stripe.com, for all payments of GymJones.com subscription fees, and does not store or have the ability to access any financial or credit card information.

All payments made to the Company for GymJones.com's subscription-based website are final and no refunds will be given, prorated or otherwise.

All cancellations must be conducted through your member profile using the edit profile link under the account dropdown menu. In the event you cancel your subscription prior to its expiration date, you will not be entitled to a refund, prorated or otherwise. Furthermore, there will be no prorated refunds for a membership that is canceled in the middle of a month.

An annual subscription plan requires a minimum 30-day notice to cancel, subject to the three (3) month minimum, and any other corresponding restrictions. Accordingly, if a member cancels on or after the 2nd of any month, then a payment will still be due the following month on the 1st. There are no refunds for membership fees, and the Company will not issue a refund for a cancelled membership, prorated or otherwise.

Failure to pay your subscription fees will result in a cancellation of your membership to GymJones.com's subscription-based website without a refund, prorated or otherwise.

The Company reserves the right to expand or restrict access to the content available on GymJones.com's subscription based website at any time, in its sole discretion, and makes no representations or warranties about the frequency with which content will be updated, or that you will be satisfied with the content that is or will be made available in the future. Further, the Company shall in no case be responsible for your inability to access the subscription-based content on GymJones.com due to an inability to access the Internet generally, or GymJones.com specifically, and no refunds shall be issued under these circumstances. Accordingly, you hereby acknowledge and agree that you subscribe to GymJones.com's subscription-based website at your own risk.

By agreeing to these Membership Terms, you agree not to share your log-in information or any content found on GymJones.com's subscription-based website with any third party without the express written consent of the Company. In the event that you share your log-in information or any of the content found on GymJones.com's subscription based website with any third party without the express written consent of the Company, the Company reserves the right to immediately cancel your membership without a refund, and to pursue any and all remedies available to it under the law.

The Company reserves the right to pursue delinquent payments owed by any and all means permissible under the law, including use of a collection agent.

All changes to your account information, including your contact and financial information, must be made through your membership profile found by selecting EDIT PROFILE from the avatar menu.

These Membership Terms are governed and interpreted pursuant to the laws of the state of Utah, United States of America, notwithstanding any conflict of law principles. All disputes arising out of or relating to these Membership Terms or your use of GymJones.com shall be under the jurisdiction of the State and Federal Courts of the State of Utah. The prevailing party in a dispute brought pursuant to these Membership Terms shall be entitled to its reasonable attorneys’ fees and costs, including costs of collection.

These Membership Terms constitute the entire agreement between the parties relating to the subject matter herein and shall not be modified except by a new posting of Membership Terms by the Company to GymJones.com, as described above. If any part of these Membership Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, then that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
